The Law and the Constitution Essay Example | Topics and Well Written Essays - 1250 words

The Law and the Constitution - Essay Example V. Dicey who made a robust restatement of this very old doctrine at the end of twenty-century. According to A. V. Dicey the principle of supremacy and sovereignty is the basis of the British Constitution. Parliament itself is not capable to confine its own future proceedings, courts cannot inquire or decline to give effect to its ratifications, and all other law-making institutions in the United Kingdom are secondary to it.Supremacy of Parliament is so magnificent and supreme, that it cannot be restricted, either for reasons or persons, under any circumstances. (Jennings, 1959) In other words, Parliament's supremacy can be estimated from the fact that it can do each fascination that is not naturally unattainable. The initial portion of Dicey's Law of the Constitution was dedicated to defying the unorthodox impression that there might be supposed boundaries to sovereignty and supreme. Dicey highly declared that the Parliament had authority and power to make or unmake any law whatever. For historical authority, Dicey naturally sought recourse to the Act of Settlement and to the pervasive constitutional traditions that dangle about the great and glorious revolution of 1688. Sovereignty had to be free, and it was for this motive that Dicey appeared so sideways at the very suggestion of international law, or undeniably those legal orders that sought to somehow share authority and power. Supremacy of Parliament can be divided into three significant essentials: firstly Parliament can formulate or unmake any law; secondly Parliament cannot force its heirs and lastly Courts cannot inquire an act of Parliament. In the light of the European Communities Act 1972 Parliament can still only do this if the legislation is not an EU parameter or instruction and is only conjugal legislation. Parliament cannot for instance rescind an Act that a EU dictate had structured the administration to make as they did in the case of Commission of the EC v United Kingdom (1979). Further the reality that Parliament cannot bind its successors is considerable. This originally predestined that a current, say Conservative government could not execute legislation that would come into power when a Labour government came into power. Now this refers to the EU in that the British government cannot outdo any legislation that would in future conflict with any recommended legislation of European Union. M ost notably according to the doctrine of Supremacy of Parliament, the courts of United Kingdom are not capable to inquire an act of Parliament. It is the reason that any proceed of Parliament is the ultimate law of the land, obligatory all through the territory, and alterable only by another act of Parliament. Parliament is defined as a congregation poised of the Commons, the Lords chronological and devout, and the Crown. Only these three institutions acting collectively include the sovereign Parliament, and were able to make law supreme throughout the realm. The Crown, Lords, and Commons unprejudiced each other; their contending interests fashioned political strains within Parliament to efficiently contain its implementation of unbounded supremacy. The Crown in Parliament obsessed total and unrestricted legislative supremacy, having the right to make or

Ininternet Addiction and How It Affects Educational Success Essay Example for Free

Ininternet Addiction and How It Affects Educational Success Essay Many people carry out most of their daily activities using the internet, for example, banking, paying bills and trading which has led to a marked dependence on the internet. According to the Center for On-Line Addiction (1998), there are several types of internet addiction: The first is Cyber-sexual Addiction where people get addicted to pornography on the internet. The second is Cyber-relationship Addiction where people make on-line friends in chatrooms and soon the online friends replace life friends and family. The third is Net- Compulsions where people engage in different compulsive behaviors such as gambling, auctions and excessive online trading. People develop an internet addiction for different reasons. Some people become addicted to the Internet because of the social connections they make online. This is because they develop emotional attachments to the online friends they ‘meet ’on social networks such as Facebook, Twitter and MySpace. The internet offers anonymity where people can talk about issues that they would not feel free to talk to close friends or family about. The internet also provides a wide array of activities which keeps people online in search of new and exciting forms of entertainment The internet has both positive and negative affects on education. Internet addiction negatively affects the social life of students; it leads to an inability to communicate in the ‘real world’. Lack of communication skills it makes it hard for students to form healthy relationships with their peers at school. The internet can also be very distracting. There are a lot of fun activities on the internet like games and social networks which distracts students from doing their school work. Internet addicts spend a lot of time on the internet which leads to exhaustion due to lack of sleep which in turn leads to a lack of concentration at school. Internet addiction continues to be a major problem in today’s society and measures should be taken to ensure that students who are addicted to the internet receive help in order to continue with their studies. Students should be made aware of the reality of internet addiction and its negative effects on their academic performance. Teachers and parents should also limit the time spent by students on the internet to enable them to achieve better academic excellence. References Centre for Internet Addiction (2011). Free College Essays - The Theme of Punishment in Hawthornes The Scarlet Letter :: Scarlet Letter essays

The Scarlet Letter:   The Theme of Punishment  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚        Ã‚  Ã‚  Ã‚  Ã‚   Hawthorne's The Scarlet Letter deals with many themes, the most powerful being punishment. In this novel, Hester Prynne becomes a highly respected person in a Puritan society by overcoming one of the harshest punishments, the scarlet letter. This object on "her bosom"; however, does the exact opposite of that which it was meant for. Eventually, Hester Prynne inverts all the odds against here due to her courage, pride and effort. Hester went beyond the letter of the law and did everything asked of here in order to prove that she is "able."      Ã‚  Ã‚  Ã‚  Ã‚   Hester became quite a popular seamstress, admired all over the town of Boston for her work. Hester is modest in everything that she does. Hester herself wears only poor clothing while she embroiders marvelous works for the rest of Boston. The only piece of clothing forbidden to create was the wedding vail. How could a woman wearing the scarlet letter create a dress that represents the values of marriage; having committed sin as she did to be involved in the marital bonds of another couple. Although she does the job willingly and rarely ever looks back to the horrid past behind. The scarlet letter was constantly worn by Hester with pride and dignity. Hester knew that what was done in the past was wrong and that the scarlet A was the right thing to do, therefor it is worn with a sense of pride.      Ã‚  Ã‚  Ã‚  Ã‚   The child, Pearl, is "a blessing and as a reminder of her sin." As if the scarlet A were not enough punishment there "was a brat of that hellish breed" which would remind Hester of what happened in the past. The "brat" could have been given away to Governor Bellingham yet Hester proclaimed that Pearl "is my happiness!...Ye shall not take her! I will die first!" Not a person in Boston, nor Hester herself thought highly of the little child and Hester refused to let Pearl go. Hester carried the kid around only because it was a direct reflection of her sin and to cast away here sin as freely as that to give it away would be unjust and unfair to Hester and Pearl.

Bank Accounts, Joint or Separate? :: essays research papers

Introduction The topic I chose to discuss is if couples have separate bank accounts and if they have arrived at this solution after trying to use a single account or if this was their first attempt at martial checking. I chose this topic because I always had the notion that a married couple should have a joint bank account, meaning that their finances just like them were intertwined and inseparable. After I was married to the love of my life, I noticed the concepts and methods we practiced regarding the monthly budget and our finances were vastly different and at times conflicting. She was brought up in a household where her parents never discussed budgets or savings, they just spent their money on whatever they wanted and when the money ran out, they would barrow to continue spending. I was brought up in a poor household where we had to scrimp and save to make ends meat. I’m sure you can figure that this was the source of a lot of conflict and hard ship in the first years of our marriage. We had tried many different techniques to settle things, but no matter what we tried conflict still arose on how the money was spent and when it was spent. Finally after researching the topic and talking to mother married couples who I knew and respected, I came to the conclusion that no matter what my personal opinion on how the finances should be, my wife and I were never going to agree on this and that I should look for another solution instead of trying to indoctrinate her with my philosophy. One of piece of advice I was given was to split up the family budget in whatever ratio is necessary and allocate the money accordingly. This resulted in my wife being put over the groceries, clothing, and school needs for the family and I was put over the rest of the bills (mortgage, insurance, phone, etc.). I also tried to find a way to tuck a little money away each month into a savings account. Since the inception of this solution we had two separate bank accounts which has resulted in my less conflict and we have been able to put money away for the future for the first time in our marital history. I wanted to research if this problem was common or not given the diversity of financial backgrounds now in society.

About Myself

Nuclear Power is produced when a nucleus absorbs a neutron and splits into two lighter nuclei. This releases enormous amounts of energy which in turn produces heat. In fact the Uranium, which is the most common element used to produce nuclear power today, has an energy content about 3 million times greater than that of fossil fuel. Consequently 1 gram of Uranium is equivalent to approximately 3 tones of coal. Nuclear reactors harness the heat which is produced from the energy released when the atom splits and convert it into electrical energy. Current Nuclear Power plants require the the use of the rare Uranium isotope U-235 and consequently only use one fifth of the total energy content. Next generation reactors forecast to be available in 2020's will use all the energy in Uranium or the more abundant Thorium. Nuclear reactors produce vast amounts of radioactive waste including large amounts of very long lived radioactive atoms. These radioactive particles are a product of the splitting of the atom. We are constantly exposed to low-level radioactivity from cosmic rays from outer space and naturally occurring radioactive isotopes which in general do not cause any harm. However at high levels of exposure there are numerous biological effects of radiation. These cause cell death, cancer induction and can cause genetic damage. The waste of nuclear reactors is highly radioactive and long lived, and as a consequence must be isolated from humans for around 100,000 years. The current consensus is that Nuclear Waste should be disposed in secure containers and placed deep underground. Future technology promises to turn the long lived radioactive particles into shorter lived atoms.

International Organizations NATO and the UN in Iraq

International Organizations NATO and the UN in Iraq Introduction The international system is the interaction between units whereby various variables at the systemic level come together to influence the external behavior of a state. In this case, foreign policies are determined by the activities at the international level. In other words, the effectiveness of foreign policy depends on the interpretation of international system, states do not formulate policies based on their available resources or manpower but instead rely on the activities taking place at the international system.Advertising We will write a custom essay sample on International Organizations: NATO and the UN in Iraq specifically for you for only $16.05 $11/page Learn More Harold Sprout and Margaret Sprout came up with ecological triad to explain foreign policy formulation techniques. In this case, the environmental factors are to be considered in coming up with a policy that would determine the relationship between a particular state and anoth er. The ecological triad captures the interaction between policy maker and the international system. The triad is composed of the actor-state, environment that surrounds the actor and the actor-environment relationship. In foreign policy, the actor is surrounded by the international system. The policy maker must behave within the complex environment that is, the international system. The environment is usually complex because there are various units such as religions, civilizations, economics and international organizations (Held 158). The environment can constrain the foreign policy maker, can provide opportunities for a certain behavior and can affect the willingness of decision makers to take advantage of those opportunities. The environment controls decision makers because it controls all limits that actors should do or not do. These entities are actually states and international organizations. The states are only controlled by the international system. In this paper, the involv ement of the international organizations that is, the NATO and the UN in Iraq is discussed. In the real sense, realists would argue that the organizations represent the interests and wishes of the developed states such as the US, France, Britain and Russia. On the other hand, the liberalists would argue that the international bodies exist to further the interests of the people of Iraq. Involvement of the International Actors NATO established itself in Iraq in 2004when the alliance was charged with the responsibility of assisting the people of Iraq to form an effective military that would counter the influence and the power of the Al-Qaida. Furthermore, the NATO alliance was supposed to offer training services to the Iraqi military in order to be counted as an international body that would operate in accordance to the international standards. On 31 December 2011, the alliance was requested to leave the country since it was perceived that its mission had been accomplished. Other actor s in the international system complained about the existence of NATO since it did not have any legal mandate to operate in the country. The NATO training mission was established after the UN Security Council resolution.Advertising Looking for essay on international relations? Let's see if we can help you! Get your first paper with 15% OFF Learn More This was after the interim government of Iraq requested the UN to use the NATO to train its soldiers. It should be understood that the formation of the NATO –Iraq was not aimed at suppressing the insurgents, as though by many people. Its main role was to offer technical and military support to Iraqi combatants. In other words, its major role was based on training, offering modern equipments, advising and offering military aid to the forces of Iraq. The NATO alliance would also guide the Iraqi into becoming an international military force that would offer quality services to the people of Iraq. Since its for mation in Iraq, the alliance was effective since it managed to offer training services to 5000 Iraqi soldiers from 2004 to 2011. Apart from training the military personnel, it also trained over ten thousand police and other security staff in the country. The member states of NATO provided various training courses to the Iraqi military. It is argued that all the 28 members of NATO offered over two thousand courses. The courses were costly by the members of NATO went ahead to offer them to the people of Iraq. Apart from training services, it is true that the Iraqi military received over 115 million Euros in form of military aid through equipments and over 17.7 million Euros in form of trust fund donations. The activities of NATO can be interpreted differently, depending on the scholar’s viewpoint and orientation. According to liberal scholars and policy makers, the main aim of NATO was to facilitate a democratic process in the country. The security sector would be modernized si nce the knowledge possessed by the military generals could not allow leaders to exercise personal and autocratic forms of leaderships. In this regard, the Iraqi government had to establish a working relationship with the NATO forces to achieve the above objective. According to liberalists, there are usually many actors in the international system. In this sense, the international system is a community of both states and human beings. Therefore, the foreign policies of Iraq had to recognize the existence of all actors, including NATO and the UN. Liberalists would argue that actions of units in the international system must be based on morality and actors must observe international codes and morals. It was upon the realization that the Iraqi military was not observant to the international codes that the NATO set its foot to salvage the situation. The military in Iraq was accused of being partisan since it only favored one side that is, the government. Saddam Hussein used the military to unleash terror to the citizens and eliminate any form of political and cultural opposition. In this case, the international actors were not happy at all. When the environment gave chance, it was the good time for NATO to act. Through this argument, universal interests are usually valued in the international system. It was the interest of each actor for peace and tranquility to be achieved in Iraq. NATO forces were therefore formed to bring this peace. As Hoffman could argue, states have a duty beyond their borders.Advertising We will write a custom essay sample on International Organizations: NATO and the UN in Iraq specifically for you for only $16.05 $11/page Learn More A state should always be concerned about the affairs that take place another state. It is the responsibility of the developed nations to ensure that human rights are to be respected and upheld at a higher esteem worldwide. The United Nations Security Council endorsed the formation of NA TO –Iraq since the lives and the militia groups led by Osama Bin Laden and Saddam Hussein did not respect THE rights of citizens. NATO forces would therefore restore normalcy and constancy in the trouble state. The US, France, Britain and Russia had to act beyond their borders since they respect the sanctity of life. Therefore, they had to facilitate training services and other forms of military aid such as provision of equipments and techniques. According to liberalism, the end does not justify the means because the means should be just and humane. In Iraq, the Hussein administration applied all forms of techniques to achieve state interests. The state interests included domination of the region and cutting links with the west (Gerd 45). This could be obtained by forming a military like administration whereby the rights of people are not respected. This was contrary to the interests and the will of the west, which would always emphasize on consultation and cooperation at the global level. The west would always argue that problems at the global level need global decisions. Iraq under Sadam Hussein could not think of any possibility of working with the west to end global problems such as terrorism, global economic crisis brought about by fluctuating oil prices and the issues related to the environment. Therefore, the NATO, after being endorsed by the UN, had to intervene to save the humanity. In case actions are to be taken in the international system, states should consult extensively in order to arrive at a win-win satiation. However, the Iraqi administration under Sadam Hussein wanted a play a zero-sum game where the west and the rest of the world would lose terrible. This was something that angered the west and the rest of the world. According to liberalists, the policy makers should always be prescriptive meaning that they have to reflect on the outcomes of the policies. The Sadam regime supported terrorism even though the outcomes of the policy wer e detrimental to the people of Iraq and the rest of the world. Iraq never appreciate the role of the international regimes such as the international law since impunity was encouraged at all quarters. The west appreciated the fact that world security could be achieved through cooperation. Therefore, activities such as nuclear disarmament and arms proliferation had to be curtailed at all costs, something that Iraq opposed always. There was no option but to facilitate military overhaul in Iraq.Advertising Looking for essay on international relations? Let's see if we can help you! Get your first paper with 15% OFF Learn More This would be best performed by the NATO alliance. Iraqi leaders believed principles in the state were based on powers but not the norms but not the norms. In this case, actions could be based on unilateralism whereby the state decides to act without consulting anybody, not even the public, which should have the ultimate powers. Some of the policy makers are always inspired by the realism, which is a very strong theory in the study of foreign relations. According to these policy makers and observers, the involvement of the NATO and the UN in the affairs of Iraq could be interpreted differently. To this scholars, the unity of analysis in the international system is the state whereby the state is usually guided by its national interests. The international system in this case exists according to the Hobbestain state of nature. In other words, the international system dictates what should be done. The NATO and the UN took advantage of the current nature of the system to invade Iraq and impose policies. For instance, the developed nations took advantage of the confusion in Iraq to change the military ideology. This would only benefit them since the military would be sympathetic and appreciative to the activities of the west in the world. Consequently, the US and the west benefited a lot since Iraq had to pay in form of oil. Indeed, the US benefited so much since a lot of oil was transported from Iraq to the US. In case states intervene in a foreign state, the interest is usually to obtain something. This is true to some extent because the US has never bothered to marshal the NATO forces to intervene in Somalia, even after the claims that the Alshabbab insurgent group is associated with the world’s most feared terrorism group, the Al-Qaeda. The US intervened in Iraq and Afghanistan because of the availability of the natural resources. This means that the US was only interested in natural resources but not bringing back sanity. Concerning the existence of NATO and the UN, they only exist as long as the powerful states would permit. The international organizations do not serve the interests of the poor states. For instance, the US invaded Iraq even after the UN had advised against the invasion. This means that the US was only concerned about its national interests, which was security. After the 9/11 attack, the US resolved to come up with long terms policies that would ensure that its citizens coexist in peace worldwide. Due to this, the hotspots in the world were focused, which led to the sponsoring of military training in the Middle East. Therefore, the NATO and the UN involvement in Iraq were not in the interest of the people of Iraq but for the interest of the American people. Currently, the peace witnessed in Iraq is conducive for American investors since they can operate without the fear of losing their stocks. It is very rare for the US to fund projects that do not benefit its population. For instance, the US cannot help in disarmi ng an enemy, which does not pose any security threat to its citizens. For a long time, the US has focused on destabilizing the Middle East because if given chance, the Middle East states can pose a serious challenge to the existence of the US and other developed nations from the west, mainly because of oil. The US allowed the formation of NATO-Iraqi alliance only to strengthen its presence and power in the Middle East, but not to better the living standards of the Iraqis. This shows that military alliance between the NATO and Iraq was out of fear and suspicion that characterizes the international system. In the international system, life is brutal, short-lived and nasty whereby states engage in a zero-sum game always. States value their sovereignty so much to an extent of neglecting ethics (Koehn and Rosenau 107). UN Failures On the flipside, the body has had a number of failures in its quest to uphold world peace and security. The UN was unable to bring order into Somalia through U NOSOM (United Nations Mission to Somalia), consequently leading to its withdrawal in 1995. This was also the case in1994 during the Rwandan genocide whereby the United Nations Mission Rwanda (UNAMIR) was unable to stop the genocide due to lack of men and weapons. In Bosnia Herzegovina, the UNPROFORC (United Nations Protection Force) was unable to stop the massacre of Serbians. Perhaps one of the most notable incidents on the inability of the UN to promote peace and security in the world was the 2003 invasion of Iraq by the coalition of the willing led by the USA. This went against a UN resolution 1441 of 8 November 2002. The resolution called for new inspections to ascertain whether Iraq had weapons of mass destruction. The US on its part ignored this resolution and instead invaded Iraq on 19 March 2003. Peace and security remains a major challenge to global governance. In many instances, the UN has been indecisive or unable to act to promote peace and security. This has led to a si tuation where matters on peace and security are championed by a handful of nations under the guise of collective security. In most cases, these countries will be pursuing their own interests. This has consequently led to issues such as terrorism arising. Terrorism has come about because of radicalism by Islamic fundamentalist who feel that the US led war on terror targets Islam as a whole. This in effect has led to violence and the loss of many lives as Islamist fundamentalists under the auspices of the global terror network Al Qaeda and other terror groups wage war on the US on various fronts. The September 11 bombing of the World Trade Center in the US was a hallmark of terrorist operations. This in turn led to the US invading Afghanistan with the aim of smoking out Osama bin Laden, the suspected mastermind of the bombings. This war on terror has also been played out in the Middle East pitting Israel, an American ally, against various Palestinian groups such as Hamas (Porter 185). In general, the UN and NATO have not been able to function independently since they only serve the interests of the powerful states. The UN for instance has been accused on several occasions for siding with the superpower. Gerd, Nonneman. EU-GCC Relations: Dynamics, Patterns Perspectives, London: Routledge, 2005. Print. Whats Next for Administrative and Executive Assistants

Whats Next for Administrative and Executive Assistants Over at The Effective Admin, Karen Porter has some advice for Executive Assistants and Administrative Assistants who are ready for the next big rung up the ladder. If you like providing administrative support, you may find reassurance in the predictable climb  upwards every time someone leaves or someone new is hired and needs an assistant. Or maybe you stumbled into admin work and are just happy to have a desk and a paycheck! But maybe now that youre settled and have  started to look around, youve realized youre on a conveyor belt of sorts. That can often feel too limited. What if you didnt have to follow a predefined path? What if you could develop your own path based on a 5- or 10-year plan? What this may mean is letting go of your title, or even your professional category and focusing instead of what responsibilities you want to hold a year or several years from now. Does your company have   roles that would afford you those opportunities? If not, is there any way you can stil l acquire some of those responsibilities outside of your normal job parameters, so they can translate on to your resume and make you appealing to a company that does have room for that position?Ask yourself: What kind of jobs offer  your dream work activities (and whatever benefits, perks, salaries, working conditions etc are your top priorities)? What sort of tasks can you add to your current roster- without changing your title- that will get you ready for your next move?Define your strengths, look for holes in your experience, and work to fill them. Make your own path, ladders and rungs optional!

10 Terms for the Common People

10 Terms for the Common People 10 Terms for the Common People 10 Terms for the Common People By Mark Nichol The English language is rich with descriptive (and generally derogatory) terms for the common person, though many are adopted from other languages: 1. Bourgeoisie: This term, derived from the French word roughly translated as â€Å"the people of the city,† refers to the middle class rather than the common folk per se, but the sense of the word is â€Å"conventional.† The petite, or petty, bourgeoisie are those of the lower middle class. Twentieth-century journalist H. L. Mencken ridiculed the ignorant masses when he coined booboisie as a pejorative play on the term. 2. Great unwashed: The common people. An epithet of contempt for the lower classes, based on the supposition that their hygienic habits are inferior to those of the upper classes. The expression is said to have been first heard in speeches around the turn of the eighteenth century, but the first documentation is in a novel by Edward â€Å"It was a dark and stormy night† Bulwer-Lytton. 3. Hoi polloi: The first word of the Greek phrase referring condescendingly to the common people means â€Å"the,† but because the phrase is not a common term in a familiar language, it is still assigned the English article: â€Å"the hoi polloi.† 4. Little people: The common people. The sense is of an inconsequential mass populace. 5. Mob: The masses as a mindless single entity driven by base or anarchic impulses. The term is a truncation of the Latin phrase mobile vulgus (â€Å"vacillating crowd†). The word is therefore an abbreviation of the adjective describing the people’s actions, not the people themselves. (From vulgus we also get vulgar, which, originally, rather than having a pejorative connotation, was a neutral term meaning â€Å"typical of people.†) 6. Peons: Menial workers. The implication is that such people can be denigrated and/or exploited with impunity. The term, taken directly from the Spanish word for a landless laborer, may also refer to indentured servants, those who are in peonage. 7. Plebeians: The common people. This word, derived from the Latin word plebeius, whose definition matches the one just given, implies small-minded attitudes and gauche behavior. Truncated forms include pleb and plebs; the plural form is plebes. (Plebe and its plural form are also slang terms for first-year students at military academies.) 8. Proles: The common people. This word is a truncation of proletariat, referring to laborers as a class. This latter term (a French word derived from the Latin term proletarius, in turn stemming from proles, or â€Å"progeny†) has an ideological connotation deriving from its use in socialist rhetoric to refer to the working people as the backbone of a society. In the slang phrase â€Å"lumpen prole,† however, the abbreviation is used in a pejorative sense with the implication that the working class consists of a mindless mob. 9. Rank and file: This phrase referring to the ordinary people in a company or organization is an extension to the civilian world of the original sense of the horizontal ranks and vertical files of soldiers in formation. 10. Riffraff: This term for disreputable people derives ultimately from rif e raf, a hybrid of English and French that means â€Å"altogether,† later evolved to â€Å"rif and raf,† or â€Å"every one.† Want to improve your English in five minutes a day? Innovation and knowledge management Essay Example | Topics and Well Written Essays - 2500 words

Innovation and knowledge management - Essay Example This research will begin with the statement that when it comes to the current competitive situations of organizations, innovation has been granted high regard by firms as it has been significantly associated with improved growth and performance through developments in quality, productivity, effectiveness and market shares. Often, the terms â€Å"innovation† and â€Å"creativity† are interchangeably used; however, primary differences can be distinguished between the two. Creativity is an essential step for innovation to be successfully applied. In fact, the current definition of innovation has become equal to creativity plus effective implementation. In the creativity stage, useful ideas are generated while the innovation process involves the course of action and the actual development of these ideas to reality. To simply put it, the innovation first starts with a particular need which brings forth a creative idea. Amabile et al suggest that all innovations start with th e formation of a creative idea. Innovation is therefore defined as a successful and effective achievement of creative ideas that are brought up in an organization. In terms of implementing a physical product or object, product design and development is extremely necessary. As in this stage, concept development, as well as the testing and manufacturing of the product or object, is undergone. When an organization has conceptualized and evaluated their ideas, through product design and development they are able to make them concrete and tangible using a systematic method.

Cellular Enviroment - Assignment Example 16-17). According to McCance & Huether (2010), cellular swelling is the initial sign of cell injury; triggered by direct damage to the cell membrane, hypoxia, or damage to the electrolyte-pumping enzymes. The most common cause of cellular injury is hypoxia, which disrupts the cell’s capability of maintaining fluid homeostasis due to deficiency in oxygen. The main cellular mechanisms of cell injury include loss of calcium homeostasis, ATP depletion, oxidative stress, damage to mitochondria, and increases permeability of membranes. These adaptive mechanisms thus fail to maintain normal homeostasis, leading to a fall in oxidative phosphorylation. This triggers the depletion of cellular ATP and the swelling of mitochondria. What follows next is the failure of membrane calcium pumps, protein synthesis, NaK ATPase pump, and generation of reactive oxygen metabolites. This leads to an influx of Na+ and water, efflux of K+, entry of free calcium into the cytoplasm, and a drop in intracellular pH. This results to accumulation of water into the cell triggered by failure of membrane NaK ATPase pump, and cellular swelling due to swelling of endoplasmic reticulum (p. 54-92). Cellular swelling during the early stages is a reversible lesion, which is non-lethal; however, it becomes reversible if hypoxia persists for some time depending on the oxygen demands of the cell. An irreversible injury leads to cell death, mainly via apoptosis or necrosis. Aging is a gradual deterioration of a mature organism leading to irreversible structural changes as time passes by. According to Brashers (2006), cellular changes facets of aging include hypertrophy, and the weakened capability to undergo mitosis. Cellular function is impaired by the deposition of lipids (lipid peroxidation products), programmed changes in gene expression, damage from free radicals and advanced glycation end products. These

Progressive Era - Essay Example Progressive reforms in states like Wisconsin, Washington and Idaho were becoming the order of the day from 1911 and some of these reforms are still used in nearly half of states in United States of America. Democracy was realized during the era since citizenry was given the mandate to circumvent political bosses and to rule directly. National medium magazines were handy in exposure of corruption through the media just as journalists today use newspapers, magazines and novels to expose corruption in the world (Alan 25). Journalists could even be nicknamed for inadequate exposure of corruption thus given them a challenge in exposing corruption. This shows the seriousness at which corruption was avoided. Promotion of women’s suffrage was evidently seen in attempt to create pure female votes in the arena. During the period, reformation on social institutions such as churches and schools were carried out. The insubstantial nature of the sponsorship value which emphasize on the ability to generate importance from the relationship in terms of management of the sponsorship (Farrelly, Quester &Buron , 2006). Heterogeneity occurs when the high numbers and the combination of the resources that are at the disposal of the firms render exact replication of the available resources. Besides that, it occurs in the case in which the firms use the differing routines and procedural steps to carry and perform the same task basing their direct consequences on the unique histories that dictate them to institutionalize. Examining what makes a British Soap Opera Essay Example for Free

Examining what makes a British Soap Opera Essay In a general sense, Soaps are continuous, serialised dramas broadcast up to three or four times a week, usually with an omnibus at the weekends. They are filmed in the same settings from episode to episode and follow very contemporary themes (this is what makes them so appealing). A gender spilt between the audience reveals that around 70% are women, so the major Soaps have a clear target audience. The majority of new soaps seek not to disturb ongoing ratings battles, but break new ground and aim their productions at different age groups. For example, Hollyoaks is relatively new and aimed at teens. Soaps consistently win the biggest share of television ratings and capture the biggest share because their content appeals to their target audience. This content, on the surface may seem simply crafted, but after close examination reveals the numerous techniques, performances and styles that are harmonised in order to make the soap successful. As an art from, Soaps emerge as a highly complex form of drama. There are many features that have to be planned using very formulaic methods so that the final product will conform to expectations. The writers must produce content that is engaging, yet open further leads on to other potential storylines. However, they also stretch the storylines as long as possible in order to allow time to pass in which they can invent new stories and close others. A common tact is to obviously allow a storyline to occupy a majority of the 30-minute slot, but spilt it with intervening storylines (which delay it from completing its course). This achieves two main objectives- the delay creates time for further writing and expansion of the main story, whilst the short storylines in between can be refreshed

Couple may like to have a honeymoon cruise trip or having a memorable cruise wedding. Besides that, cruises is also one of the choice for family, friends or company trip as there have a lot of activities ranging from snorkelling and biking to sauna and spa treatments. The way of booking this cruise package system is almost same as the hotel booking systems. Besides that, this system also can provide some theme for user to select such as family cruises, luxury cruises, holiday cruise, week end cruise and so on. This system can generate more sales for the AirAsia and get more users to use the AirAsia website to plan and book for vacation. Question 2 (a) Functions: Payment methods, 1-Click Card and multi currency pricing system From the system that we have chosen, I would like to discuss about the payment function that are available for AirAsia booking system. Every traveller who purchases their ticket from the website or mobile phone is requiring making the payment prior their purchase. After they have entered their guest information and the additional service that they needed, they are require to choose which payment option and method they would like to use. The payment options are VISA, Master Card or American Express and they can use credit card or debit card, e-gift voucher and direct debit to pay it. Let look at them one by one to see how to use this method to make payment. For the credit or debit card payment, it is the same as the normal way of payment that we use to pay for things that we purchase online. The travellers are required to choose the type of card that they would like to use to make their payment. Then enter their card details on the screen and billing address. They must ensure that the information is the same with the credit or debit card information. Before click on the word Pay to make the payment, they must double check whether the final amount and guest name are correct. After that, be patient to wait for around 45 second for the system to process the transaction. When it is successful, their travel itinerary will automatically appear for them to print and it is also email to them. Direct Debit is another method where the travellers can choose to make their payment. First, they must click on the Direct Debit tab and choose their preferred Bank for payment. There are Maybank, Public Bank. CIMB Clicks, AmOnline and BankRakyat. After selecting the bank that they would like to use, there will be pop-up windows on their preferred bank. They are required to login to their bank account in order to process the payment. To perform the transaction, they must select the account and confirm the payment details by clicking Next. Verify the account by key in their Identification Code (IC) or Passport Number and click Confirm to precede the transaction. Before log out from the page, they must print their payment details for future reference. Once all this is done, the travel itinerary will be display. Traveller can also pay using the E-Gift Voucher (EGV). They can get the EGV by purchasing it online or get it as a gift from AirAsia. They can use it by key in the E-Gift Voucher Number and password. If they have more than one voucher, click on + to add the next voucher by key in the number and password. When there are any remaining balances after deduction from the voucher, they need to pay it using credit or debit card. So they must click on the Credit / Debit Card tab to proceed. Then they must do the same process as the credit or debit card payment explained in the second paragraph. After all the payment, the travel itinerary will appear for print. In additional, there are this new features added to bring convenience to travellers who always purchase flight ticket using the credit or debit card. This is called 1-Click Card. It will change the way they can complete their payment as previous. Now, they do not need to fumble and rush to key in their card details. Before they are able to use this 1-Click Card, they must add their favourite cards into the list on their account. How can they do so? They must login their account in AirAsia.com and go the My Profile. Then move the mouse to My 1-Click Card and select Add/Delete details. They are required to add on their card details for all the mandatory fields and save it. However, they can only add a maximum of 3 cards in this feature. So whenever they need to book any ticket online no matter through web or mobile, they can just click on the card they want to use for purchase without key in the details. Besides that, AirAsa has currently cooperated with The Royal Bank of Scotland (RBS) to provide a multi-currency pricing system to it online system. These systems enable the travellers can immediately get the actual price that they are paying according to their country currency. This could enhance the company online sales by eliminate the uncertainty of exchange rates fluctuation. For now, the currencies available for online sales are US dollar, Singapore dollar, Hong Kong dollar, pound, and Australian dollar. Question 2 (b) Improvement on the payment system There are many customer complaints that they face problems when they are making payment for their flight ticket. When they have finish entering all their card details and click Pay, some of them may even get a page stated that our site is experiencing high traffic, please try again later after they key in the payment details especially during promotion period, facing an error or connection problem. Some may also face problem when they tends to make payments for two different routes flight. For example, there are these customers who plan to help his friends to purchase the flight ticket using his account. For the current system, he can only make the booking by finish the first booking before book for the second flight. But there are these chances where he has successfully paid for the first ticket and when he purchase for the second ticket, he now face an error that state that the payment was unsuccessful. Therefore, as an improvement, I would like suggest to AirAsia that they should upgrading its payment system that enables the customer to book two different route tickets with just one payment with his credit or debit card. How to do so? First, AirAsia should meet with the bank officer that that they have relation on the system and those IT management team to discuss on how to apply this function to the current booking system. After all the discussion, they must design the system to apply. They can put an extra box in the booking section where they can tick on whether they are purchasing more than one ticket. If they tick it, they will be shown with two columns for them to enter the destination and date they are going. After entering it, they will be shown with two fare prices for the different route tickets and they are required to choose. Then they have to enter two type of information. One is for the first trip guest information then another for the second trip as they may be different guest. After all the booking details, they come to the page where they need to make the payments. Now the system must be able to sum up the total price for both of the ticket purchase and the additional charges on other services. Then the customers choose on the payment method that they wanted to use and click Pay. So they are now able to make two ticket purchases with just one time of payment. For the bank site, they must enable the customer to make their payment online although it might be a huge sum. Their customer service centre can also call the customer and confirm on their purchases. With this planning and designing, they must test on this system to see which one is more workable or not on the current system before implementing. It must also be user friendly for the customers to use. So with this new function, the customers can now book ticket from Kuala Lumpur to Bangkok and ticket from Melbourne to Taipei with one payment with their credit or debit card. It is now easier and time saving for the customer as they can save their time to purchase it two times. It is also reduce the chances for them to get the error problem. Question 2(a) Functions: Skybus, Skyvan, advertising, Help and Info Airasia creates airline system to provide useful and convenient for the users. Advertising is also available on airline system. We learnt that there are few companies that have collaborated with skybus such as Airasia, Maxis and Digi. There are three types of advertisement for allowing companies to advertise including bus painting advertisement, on board advertisement and websites advertisement. The airline system also added few tabs at website including schedule, photo gallery, newsroom and help and info. As we know skybus schedule, it operates daily throughout the year, including public holidays. During peak-season, bus ran at a 15 minutes interval and 30 minutes interval off peak. Therefore, it is convenience for us to get ride straight away and no time is wasted. One of the tabs of Airasia is photo gallery at airline system. We could have a look at various type of Lcct opening, new buses1, new buses 2, skyvan and award. Besides that we could at least figure out the image of the skybus and skyvan from the front view and back view. The photos also prove the awards they have received. In order to let many users know about the latest event, Airasia will updated the advertisement on the home page. For example, they provide bus services to Sepang circuit from 8 April to 10 April 2011.The airline system also provide the detail of skybus schedule and price ticket. Furthermore, airline system also provides newsroom. It has posted lots of articles about skybus from newspaper such as news trait times, star metro and the edge Malaysia. It can enhance people knowledge and increase the reliability of Malaysia. Moreover, Help and Info is provided by Airasia. For enquires and customer services, user can contact them by reaching+6(016)-2176950 from 9 am to 10p.m.Another choice is sending a letter or email to them. In addition, it also provides FAQ and term and condition. In order to improve the service, t hey also created online feedback on online system so that people will give more opinion and Airasia appreciates the compliment from the users by posting them on the wall to share it with everyone. From the above information, users can compare among the airline services (Airasia, Mas airline and firefly )which are more convenient for them. For example, they may find out that Malaysia airline do not provide low cost transport such as skybus. For people who are of average family, they are not willing to spend on expensive transportation fee. Due t o economic crisis, most of people try to do research for the cost and make a budget for themselves. To determine whether is it worth or not, they may want information about flight ticket and transport fee charged by airline and also include the time taken from airport to their destination Most of the users using the airline system are travel agency, businessman, traveler and employees. Excavating an African Burial Ground: Lack of Funding Could Mean Loss o

Excavating an African Burial Ground: Lack of Funding Could Mean Loss of Information Forever As children growing up in the United States, educated through our public schools, we learned about the institution of slavery, which was an integral part of life in our country for nearly 300 years. We do not usually question the historical facts we learned about slavery or ask how we know so much about the history of these people (the enslaved Africans in America) who left behind so little written record. In the classroom, archeologists do not receive much credit, but it is largely through their work and research that we have been able to learn about â€Å"America’s diverse ethnic heritage† (Singleton 155). In the 1960’s, excavations of slave cabins inspired a new area of research. Today’s field of African-American Archaeology was born from these first digs, only three decades ago. Archaeologists carefully and skillfully collect artifacts, which are â€Å"tangible material remains and by-products of behavior† (Singleton 156). Through historical and ethnographic analysis and interpretation, archeologists are able to put together pieces of the daily lives and living conditions of the first African-Americans. One such African-American archaeological dig, called the African Burial Ground Project, is currently taking place in New York City. In 1991, the construction crew for a new, $276 million federal office building stumbled across the skeletons of what are now known to be early African slaves. The United States General Services Administration (GSA), the government agency that handles the funding and administration of all federal property, began further exploration of the site. The Moon :: essays research papers

The moon   Ã‚  Ã‚  Ã‚  Ã‚  The moon is the only natural satellite of Earth. The moon orbits the Earth from 384,400 km and has an average speed of 3700 km per hour. It has a diameter of 3476 km, which is about  ¼ that of the Earth and has a mass of 7.35e22 kg. The moon is the second brightest object in the sky after the sun. The gravitational forces between the Earth and the moon cause some interesting effects; tides are the most obvious. The moon has no atmosphere, but there is evidence by the United States Department of Defense Clementine spacecraft shows that there maybe water ice in some deep craters near the moon's North and South Pole that are permanently shaded. Most of the moon's surface is covered with regolith, which is a mixture of fine dust and rocky debris produced by meteor impact. There are two types of terrain on the moon. One is the heavily cratered and very old highlands. The other is the relatively smooth and younger craters that were flooded with molten lava. Throughout the 19th and 20th centuries, visual exploration through powerful telescopes has yielded a fairly comprehensive picture of the visible side of the moon. The hitherto unseen far side of the moon was first revealed to the world in October 1959 through photographs made by the Soviet Lunik III spacecraft. These photographs showed that the far side of the moon is similar to the near side except that large lunar maria are absent. Craters are now known to cover the entire moon, ranging in size from huge, ringed maria to those of microscopic size. The entire moon has about 3 trillion craters larger than about 1 m in diameter. The moon shows different phases as it moves along its orbit around the earth. Half the moon is always in sunlight, just as half the earth has day while the other half has night. The phases of the moon depend on how much of the sunlit half can be seen at any one time. In the new moon, the face is completely in shadow. About a week later, the moon is in first quarter, resembling a half-circle; another week later, the full moon shows its fully lighted surface; a week afterward, in its last quarter, the moon appears as a half-circle again. The entire cycle is repeated each lunar month, which is approximately 29.

Psychology assignment Essay

Conformity involves a change in behaviour or opinion in order to fit in with a group. This may be family or peers (a membership group) or it may be pop and sports stars (a reference group). This group can be either a majority or a minority group. (S-cool Student Site)  Two processes have been identified in causing people to conform (Deutsch and Gerard (1955)), these are normative influence which often comes from peer pressure such as fear of rejection and wanting approval and informational influence which is the fear of looking unintelligent and believing others know better especially with something unfamiliar or difficult. There have been many studies done by psychologists into why people conform two examples of which are Zimbardo et al (1973) and Moscovici et al (1969) which are described as follows:  Zimbardos aim in his Stamford prison experiment was to examine conformity to social roles and expectations in other words to see the effect of making ‘good’, ‘normal’ people into prisoners and prison guards.  The procedure for the experiment was that twenty-four middle class male students who were mentally sound in tests and without any criminal convictions were paid fifteen dollars a day and divided into prisoners or guards by the flip of a coin. The prisoners were arrested at their homes, blindfolded and taken to the psychology Department of Stanford University that had been converted into a realistic prison. From there the prison regime was established, the three guards were given khaki uniforms dark glasses and wooden batons, the prisoners were issued uniforms and put into cells. They were informed that no physical aggression was permitted. The participants were then left to their roles of either prison guard or prisoner. The findings of the study were that the prison guards became more and more verbally and physically aggressive. The prisoners rebelled against the guards after only one day and fire extinguishers were used to control the prisoners. The prisoners became depersonalised and suffered emotional depression, one prisoner had to be released after only one day and two more on the fourth day. The study was abandoned after only six days instead of the planned fourteen. Zimbardo believes that the study demonstrated the powerful effect roles could have on people’s behaviour. The participants were ‘playing the role’ that they thought was expected of them in particular the stereotyped view of how prison guards behave. In other words they were conforming to an ‘unofficial script’. The prison environment played an important part in how the guards behaved as none had shown sadistic tendencies before the study. The study has been criticized because of the lack of informed consent the participants had and the humiliation and distress experienced by the prisoners. Zimbardo was also criticised for acting the role of ‘prison superintendent’. In Zimbardos defence he only found out himself late on that he had the backing of the police to do the arrest and there was no time to tell the participants. He also couldn’t really tell them what was going to happen without it becoming unrealistic. The study was stopped early and the participants had no lasting effects from the study, after extensive debriefing and follow-ups years later. Infact they revealed they had learned an important lesson in that we can all be overwhelmed by social influences. Zimbardo himself now acknowledges that he shouldn’t of acted the role of superintendent but still believes that there should still be an independent monitor in this sort of research so that not only are the participants protected valuable information can also be acquired.

Rain of gold Essay

In â€Å"Rain of Gold† is a detailed history of three generations of two families that have adventures and struggles overcoming many obstacles such as poverty, violence and discrimination. Initially caught up in the Mexican revolution of 1910. Tracing their migration to the United States and the difficulties they faced, it portrays an accurate picture of life in Mexico in the early 1900’s and in the coastal area of California during the time of prohibition through the 1930’s. . Socially Espirito lived in poverty that he needed some money for his people he had some sweet water that he had gotten from the Rio Urique River to go and sell it to Don Carlos store because they were poor and wanted some money for their people. So then he gave Don Carlos some gold nuggets that were worth a lot of money so he started trading the stones for food and clothing after don Carlos saw how much he was making then later, he made an offer to espirito to sell him the part of the spring but the spring was from the people who use it. Politically don Carlos sold the river because he could not get more gold because he and espirito they made an agreement saying that don Carlos will be able to only get the gold from the top part of the canyon cliff and not to dig any part around the river. So after a couple of years he knew that the best thing to do was to sell the canyon cliff to someone else. Don Carlos sold the canyon cliff to Bernardo Garcia he was a rancher that had no fear to no one or anything, he decided to dig into the river to get more gold out of it, went he knew that he wasn’t getting gold anymore he sold the canyon cliff to an American miner’s company. Everything around canyon cliff started to disappear by constructing large buildings, roads after the company prospered in 1910. Economically espirito peoples was really affected when they got kicked out of the canyon cliff because the money they were making it was for the American mining. Socially Lupe Gomez had to work at a young age and she also would help her mother with the mineros to make the food, but one day moved with her family to the U.S. in 1923 to work in the cotton and fruit fields of Arizona and California and married Juan Salvador Villasenor, who had taken a similar route, in 1929. Socially Juan was in so much in discrimination when he left Mexico to go to Los Angeles with his family.one day Juan went to a cafà © to eat breakfast and he asked for ham and eggs and coffee when the man saw him he told Juan â€Å"but you see, my waitress, she’s new and so she didn’t know we can’t serve the Mexicans.†(Villasenor pg.232). Like on where I saw on a video that there was this soldier that was working for 38 months in the u.s.a he went to this restaurant and on outside the restaurant he saw a sign that said â€Å"no Mexicans allowed.†(Los Mineros). The Mexicans were discriminated just because they were Mexicans or also because of their skin color. Politically, the laws in the United States in the 1900s was the Mexicans were not allowed in restaurants, schools, stores, and other places just because of their skin color and because they were Mexicans. Economically In conclusion, this story is based on how this families have differences between the two families’ difficult journeys of survival yet, portrays their similarities and how their journeys culminate in the joining of the two families through the marriage of the youngest son of the Villasenor family and the youngest daughter of the Gomez family. The two families experience contrasting journeys as Juan’s family was poor in Mexico after once being rich, however, in the United States, his family becomes better off due to Juan’s entrepreneurial activities. Meanwhile, Lupe’s family does not experience the same fortune as they leave Mexico as a lower-middle class family that supported itself through its serving food to miners and occasional finding of gold, and they are not able to obtain economic prosperity when crossing into the United States and struggle to settle down and are continuously moving as they work in the fields picking crops from one place to another following the harvest. Despite the difficulties that these two Mexican families suffer in their attempt to escape the Revolution and in their hope of a better life in the United States, Rain of Gold depicts the social and economic struggles of Mexican families and the prejudice they experience in the United States and how Mexican immigration is similar to African immigration as well as Chinese and Japanese immigration into the United States. Prior to both families’ immigration to the United States, Juan and Lupe’s families are centered around their mothers. Bibliography All the sources I used: 1. Victor Villasenor 2. Acuna 3. â€Å"Los Mineros† PBS.1992.

Tourism Product Report Essay Example | Topics and Well Written Essays - 1000 words

Tourism Product Report - Essay Example On the other hand, tourism product can be defined as a service that can only be put to some use for deriving benefits. There are a number of features which are of relevance to the way in which travel and tourism products are managed and differentiated from physical goods. These include intangibility, inseparability, perishability, heterogeneity, and ownership (Evans et al. 2003:1994). Intangibility of tourism products makes this business diversified yet accessible to all. Unlike goods, services such as accommodation in a luxury hotel and cruising to an exotic island cannot be bought in physical terms. In other words, these services can only be used by customers and service providers alike. Customers make use of them for fulfilling their purpose of travelling whereas service providers put them to use for making profits. In either way, they cannot be physically located but be experienced only. Baum (2006) argues that in a culturally diversified setup, the intangibility of tourism products enables tour operators and travel agents to adjust to the varying demands of visitors (151). They can increase the stake of services, wherever necessary, to optimise revenues. At the same time, the invisibility phenomenon associated with intangible service products poses some major challenges to overcome. Intangibility itself is an attribute that sometimes appears vague and superf luous. Unless the service itself proves its worth, potential customers may completely or partially ignore it. To take away the equivocation, tour operators usually apply tangible means to promote their services to target customers. This is why video clippings of holiday destinations or cruise ship tours are uploaded on the web to lure in customers into availing of the services. Similarly, tour organisers spend time and money to make creative and visually appealing travel brochures to minimise the uncertainty factor involved with intangibility. Inseparability of tourism products is again a

Contract Scenario Article Example | Topics and Well Written Essays - 2500 words

Contract Scenario - Article Example One of the first requirements in order to a valid contract to exists is that there must be an offer and an acceptance of that offer.1 A contract will be deemed to exist when an offer has been made by one party which has been accepted by the other party for a mutually agreed consideration, and the acceptance has been communicated to the offerer. In this scenario, at the outset, a distinction needs to be made between an offer and an invitation to treat. An offer is an indication of the willingness to contract, with the intent to be bound by it as soon as the offer is accepted, whereas an invitation to treat is when offers are being solicitor which the offeree is then free to accept or receive. The consideration in this case is the amount of 4000 plus pounds which is the sum payable for receiving the contract in exchange. In the case of Currie v Lisa2 consideration has been defined as "' some right, interest, profit or benefit accruing to one party, or some forebearance, detriment, loss or responsibility given, suffered or undertaken by the other." In this case, the question of consideration can be fairly easily established since Andrea is receiving a sum of cash to compensate her for the detriment she is suffering through the loss of her caravan. Therefore there is scope for formation of contract on the basis of consideration, to show that contracts can be formed, if other terms apply, such as offer and acceptance and the communication of that acceptance. Andrea has placed the notice about her caravan which states her terms of sale clearly, i.e, the price of 4750 pounds and her telephone number. The first question that arises is whether this in effect, constitutes an offer or whether it is more likely to be considered to be an invitation to treat. Andrea's note on her caravan will not strictly constitute an offer. Merely displaying the goods with a price ticket on them is not an offer; it is only an invitation being extended to potential buyers to make an offer to buy. An invitation to treat, as in an advertisement, is different from an offer in the sense that it does not bind the one making the offer. In the case of Fisher v Bell 3 the display of a flick knife with a price tag in a window was held to be an invitation to treat and not an offer. In PSGB v Boots4 the Court clarified that it is only after the offer is accepted and communicated that a contract will come into being. Hence, Andrea's display of the note on her caravan does n ot mean that she has is bound to it as soon as her offer is accepted, she is merely inviting potential buyers to make an offer so that she can consider whether or not she wants to accept it. For a contract to be valid, "there must be a definite offer mirrored by a definite acceptance."5 An acceptance will be said to occur when the offeree's words or conduct can give rise to an objective reference that he/she has assented to the terms offered.6 If the offeree has some queries or tries to change the terms in any way, the original offer, therefore it will be rejected and a counter offer will take its place, based upon the new terms that constitute the counter offer. For example, in the case of Hyde v Wrench7 the plaintiffs sent a telegram to the defendant on the price of the product but the defendants responded with their own offer, which was held to be a counter offer and therefore did not constitute acceptance. Bernice has contacted Andrea but instead of accepting Andrea's offer,
